These Terms, Conditions & Privacy Policy (“Terms”) govern the use of this website and services provided by KLS Consulting LLC, doing business as KLS Car Wash (“KLS Car Wash,” “we,” “our,” or “us”), including the Dirty Dawg — Quitman and Rainmaker — Whitehouse car wash locations.

By accessing this website, purchasing a wash, entering or using a KLS Car Wash property, using car wash equipment, or otherwise using our services, you acknowledge these Terms to the extent permitted by applicable law.

CAR WASH USE AND CUSTOMER RESPONSIBILITY

Customers are responsible for determining whether their vehicle is suitable for the selected car wash equipment and for following all posted instructions, warning signs, clearance restrictions, employee directions, and equipment instructions.

Before using any automatic or self-service wash, customers are responsible for:

Closing all windows, doors, sunroofs, trunks, hoods, and tailgates.
Securing or removing loose items from truck beds and exterior areas.
Retracting or removing antennas when appropriate.
Turning off automatic windshield wipers.
Securing mirrors and other movable exterior components when appropriate.
Removing or securing magnetic signs, temporary accessories, and loose exterior items.
Ensuring the vehicle is mechanically capable of safely entering and using the wash.
Observing posted height, width, tire, and vehicle restrictions.
Following all instructions regarding transmission, braking, steering, and vehicle operation.

Customers should not use equipment on a vehicle that has loose, damaged, cracked, rusted, previously repaired, improperly installed, or otherwise compromised components.

VEHICLE CONDITION, ACCESSORIES AND PRE-EXISTING DAMAGE

KLS Car Wash is not responsible, to the fullest extent permitted by law, for damage caused or contributed to by the condition of a vehicle rather than the proper operation of the car wash.

This may include damage involving:

Loose or damaged trim
Moldings and emblems
Antennas
Windshield wipers
Mirrors
Running boards
Roof racks
Bike racks
Cargo carriers
Bed covers
Toolboxes
Spoilers
Bug shields
Grilles
License plate frames
Tow hooks
Trailer hitches
Aftermarket lighting
Aftermarket wheels or tires
Oversized tires
Modified suspension
Aftermarket accessories
Vehicle wraps, decals, graphics or protective films
Previously damaged paint or clear coat
Chipped, cracked or weakened glass
Previously repaired body components
Rust, corrosion or deterioration
Loose or damaged convertible tops
Non-factory or improperly installed equipment

Use of the wash with such items or conditions is at the customer's risk to the extent permitted by law.

AFTERMARKET AND MODIFIED VEHICLES

Vehicles containing non-factory equipment, modifications, aftermarket accessories, oversized components, custom bodywork, wraps, specialty finishes, lowered or raised suspension, or other alterations may not be compatible with standard car wash equipment.

The customer assumes responsibility for determining whether such modifications are suitable for the equipment being used.

KLS Car Wash reserves the right to refuse service to any vehicle that we reasonably believe could create a safety hazard or risk of damage to the vehicle, equipment, property, employees, customers, or others.

SELF-SERVICE EQUIPMENT

Self-service equipment may include high-pressure water, chemicals, hoses, wands, vacuums, moving components, and wet surfaces.

Customers must use equipment only for its intended purpose and according to all posted instructions.

Do not direct high-pressure spray toward people or animals. Customers should exercise particular caution around painted surfaces, damaged vehicle components, glass, convertible tops, decals, wraps, electrical components, and other areas susceptible to pressure or chemical exposure.

Customers are responsible for damage resulting from misuse of self-service equipment.

PERSONAL PROPERTY

Customers are responsible for personal property located in or around their vehicles.

To the fullest extent permitted by law, KLS Car Wash is not responsible for unattended, lost, misplaced, stolen, blown away, discarded, or damaged personal property unless liability is otherwise imposed by applicable law.

Customers should secure valuables and loose objects before using the facility.

SAFETY AND PREMISES CONDITIONS

Car wash facilities naturally involve water and may contain wet or slippery surfaces, hoses, curbs, drains, moving equipment, vehicles, cleaning chemicals, and other conditions normally associated with a car wash.

Customers and visitors must exercise reasonable care while on the premises.

Children must be appropriately supervised.

Customers must not enter restricted areas, equipment rooms, machinery areas, or other areas not intended for customer access.

ASSUMPTION OF INHERENT RISKS

By voluntarily using car wash equipment or entering areas associated with car wash operations, customers acknowledge and assume the ordinary and inherent risks associated with such activities, including risks associated with water, wet surfaces, moving vehicles, automated equipment, high-pressure equipment, hoses, cleaning products, and other ordinary car wash conditions.

IMPORTANT NOTICE — RELEASE REGARDING ORDINARY NEGLIGENCE

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS LEGAL RIGHTS.

TO THE FULLEST EXTENT PERMITTED BY TEXAS LAW, A CUSTOMER WHO KNOWINGLY AND VOLUNTARILY USES KLS CAR WASH SERVICES EXPRESSLY RELEASES KLS CONSULTING LLC, DOING BUSINESS AS KLS CAR WASH, AND ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, AGENTS AND AFFILIATES FROM CLAIMS FOR VEHICLE OR OTHER PROPERTY DAMAGE CAUSED BY THE ORDINARY NEGLIGENCE OF KLS CAR WASH IN CONNECTION WITH THE NORMAL OPERATION OR USE OF CAR WASH EQUIPMENT OR SERVICES, EXCEPT TO THE EXTENT SUCH LIABILITY CANNOT LAWFULLY BE RELEASED OR LIMITED.

THIS PROVISION IS INTENDED TO EXPRESSLY INCLUDE CLAIMS ALLEGING THE ORDINARY NEGLIGENCE OF KLS CAR WASH.

This provision does not waive or limit liability for gross negligence, intentional misconduct, fraud, or any right or remedy that applicable law does not permit a consumer to waive.

DAMAGE OR INCIDENT REPORTING

If a customer believes a vehicle or other property was damaged while using our facility, the customer should report the incident to KLS Car Wash before leaving the property whenever reasonably possible.

Prompt reporting allows us to inspect the vehicle, preserve photographs or video when available, review equipment conditions, and investigate the circumstances.

A report of an incident does not constitute an admission of responsibility or liability by KLS Car Wash.

KLS Car Wash reserves the right to investigate any claim and request photographs, vehicle information, repair estimates, ownership information, prior damage information, or other documentation reasonably necessary to evaluate the claim.

VIDEO SURVEILLANCE

For security, safety, loss prevention, operational, and incident-investigation purposes, portions of KLS Car Wash properties may be monitored or recorded using video surveillance.

Surveillance recordings may be retained, reviewed, or disclosed when reasonably necessary for safety, security, investigation of incidents, legal compliance, insurance matters, protection of property, or law-enforcement purposes.

There should be no expectation of privacy in publicly accessible exterior or car-wash operating areas where surveillance is lawfully conducted.

EQUIPMENT AVAILABILITY

Individual bays, vacuums, automatic washes, payment systems, or other equipment may occasionally be unavailable because of maintenance, repair, weather, utility interruption, equipment malfunction, or circumstances outside our reasonable control.

Availability of equipment is not guaranteed.

WEATHER AND EVENTS OUTSIDE OUR CONTROL

KLS Car Wash is not responsible, to the extent permitted by law, for losses or delays arising from severe weather, freezing conditions, flooding, lightning, wind, utility outages, Internet or payment-processing outages, governmental action, vandalism, criminal activity, natural disasters, or other circumstances beyond our reasonable control.

WEBSITE INFORMATION

We attempt to keep information on etxcarwash.com accurate and current. However, operating hours, equipment availability, services, pricing, promotions, and other information may change.

Information on the website does not create a guarantee or warranty unless expressly stated otherwise.

THIRD-PARTY LINKS AND SERVICES

Our website may contain links to or integrations with third-party services, including Google Maps, social-media platforms, Wix, payment processors, analytics services, and other providers.

KLS Car Wash does not control independent third-party websites and is not responsible for their content, availability, security, terms, or privacy practices.

LIMITATION OF DAMAGES

To the fullest extent permitted by applicable law, KLS Car Wash shall not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or services where such damages may lawfully be excluded.

Nothing in these Terms is intended to eliminate a statutory or consumer right that Texas or federal law prohibits us from waiving.

NO GUARANTEE OF RESULTS

Vehicle cleanliness may vary depending upon vehicle condition, type and amount of dirt or contamination, weather, vehicle design, selected wash service, and other factors.

Unless specifically stated otherwise, purchase of a wash does not guarantee removal of every stain, contaminant, insect, mineral deposit, road film, tar, tree sap, oxidation, or other material.

RIGHT TO REFUSE SERVICE

KLS Car Wash reserves the right to refuse or discontinue service when reasonably necessary to protect customers, employees, equipment, property, or operations, including for unsafe vehicles, misuse of equipment, threatening conduct, vandalism, fraud, violation of posted rules, or other inappropriate activity.
